Indiana offers limited online gambling options for players, a similar stance on the offline gambling forms where casinos, racetracks, and off-track betting facilities are not plentiful. However, the state has been open to the idea of improving its gambling space, with the past years pointing to this fact. We look at the current gambling status in the Hoosier State and what the law provides.

Online casino gambling is illegal in the state. Despite IN operating several land-based casinos within its borders, residents cannot play any IN online casino for real money as it stands. However, there have been numerous attempts to have online casinos legalized in the state, most recently the 2021 legislative bill developed by Sen. Jon Ford.

Under the SB 417 bill, the state’s casinos and racetracks would have the mandate of offering online casinos for Ind. residents. Therefore, each license holder would offer up to three skins. In addition, the planned Indiana Hard Rock Casino would also have the license to operate online casinos, adding to the list of more potential online casinos.

Other vital details included on the bill include:

  • Interactive gaming license for the casinos and racinos to cost $500,000.
  • Annual license renewal fee to cost $50,000.
  • Each casino can host up to three skins or online brands.
  • The license for the Internet gaming operators to cost $100,000.
  • The annual license renewal fee for the internet gaming operators to cost $25,000.
  • Internet gaming revenue to be taxed at 18%, including 3% for local governments.
  • The Addiction Services Fund to have an input of 3.33% from the state tax revenue.

While IN players wait on the progress of the bill, what legal options are available? The law allows social casinos, accessible on Facebook or other similar sites. The Hoosier State specifies that all games available are legal, provided they are games of skill. The law goes ahead to illegalize any game of chance or any game that requires payment to participate in these social casinos. One major point to note is that there is no real-money exchange on social casinos. Instead, one can have points rewarded that add to the playing time. One cannot claim real-money prizes or cash.

Offshore casinos are other options IN players have. Unfortunately, the state doesn’t legalize them and categorizes illegal gambling over the internet as a Class B misdemeanor and is punishable by law. However, even while the state is explicitly clear on its law, some offshore sites still accept IN players. Those wishing to play for real money can register with these casinos to play games ranging from online slots, table & card games, live dealer games, instant games, video poker games to keno. One major drawback of offshore casinos is that they do not offer the most reliable consumer protection and may be a menace when settling a dispute.

Indiana Gambling History

  • 1851: The Indiana constitution banned lotteries, which the courts generally interpreted as banning gambling. This led to gambling going to the ‘black market’ with no gambling form legalized in the state.
  • 1988: The IN voters approved an amendment that saw the lottery ban lifted. Thus, the state established the Hoosier Lottery.
  • 1989: The Hoosier Lottery began its operations in the state by selling scratch-off tickets. Additionally, Indiana legalized pari-mutuel betting in the state. Still, in the same year, Thomas Barnes, mayor of Gary, brought an initiative to allow casinos to operate. The state’s legislature did not initially approve the initiative but allowed the voters to vote for or against the initiative through a referendum. The initiative would pass with 60% of the votes.
  • 1990: Following the initiative’s success, Mayor Thomas Barnes embarked on finding land for future casino use. While at it, the lawmakers opted to legalize riverboat casinos across the entire state. However, the bill was unsuccessful, similar to the 1991, 1992, and 1993 attempts. The attempts were from Rep. Charlie Brown of Gary (Democrat) that called for authorization of riverboat casinos on the Ohio River and a casino in West Baden Springs and French Lick. In addition, Indiana became part of the Multi-State Lottery Association in 1990.
  • 1992: The Hoosier State became a co-founder of the popular Powerball product.
  • 1993: The state lawmakers did not pass a budget before the expiration of the spring session. As a result, Gov. Evan Bayh summoned a special session that became a perfect hub for Democrats. The Republicans agreed to approve Brown’s bill in exchange for the state not raising income and property tax rates.

The law allowed the state to host eleven (11) riverboat casinos, with five (5) allocated to the Ohio River, five (5) to Lake Michigan, and one (1) to Patoka Lake. Licensing required local voting, which was majorly successful.

Will Indiana Regulate Online Gambling in the Future?

The chances of legalizing IN online gambling are looking great. As it stands, online sports betting is out of the way after its legalization in 2019.
